U.S.C. §§ 2257 & 2257A Compliance Statement

1. Purpose of This Statement

This policy explains how MatchAI's services relate to the record‑keeping requirements imposed by 18 U.S.C. § 2257 (actual sexually explicit conduct) and 18 U.S.C. § 2257A (simulated sexually explicit conduct or lascivious exhibition of genitals). It clarifies why those statutory obligations do not apply to our platform and affirms our commitment to lawful and responsible operation.

2. Basis for Exemption

2.1 Nature of the MatchAI Platform

MatchAI is an AI‑driven curation and bridging service. We connect users to AI-generated text and image personas. We do not create, host, or distribute images, videos, or other visual depictions involving real human beings engaging in explicit conduct.

2.2 Curated AI-Generated Images

MatchAI does not allow users to upload characters or avatars to our servers. Any visuals on our platform are exclusively AI-generated images manually curated by our team, or pulled from approved partner platforms. Because no images depicting actual real‑life conduct covered by §§ 2257 or 2257A are hosted on the platform, the record‑keeping obligations of those sections are not triggered.

2.3 No Visual Depictions of Actual or Simulated Explicit Conduct

Our curation ensures that no visual depiction hosted on MatchAI falls within the definitions of "actual sexually explicit conduct" (18 U.S.C. § 2256(2)(A)) or "simulated sexually explicit conduct" / "lascivious exhibition of genitals" (§ 2257A) of real people.

2.4 Outside the Statutory Definition of "Producer"

The term "produces," as defined in 18 U.S.C. § 2257(h)(2)(A), refers to activities such as filming, photographing, or otherwise creating a visual image of an actual human being engaged in sexually explicit conduct. MatchAI performs none of these acts; therefore, the platform is not a "producer" for purposes of § 2257 or § 2257A.

3. Compliance Commitment

While the specific record‑keeping obligations of §§ 2257 and 2257A are inapplicable, MatchAI nonetheless:

  • Maintains internal review processes to ensure all AI-generated artwork complies with our safety standards and does not depict minors in suggestive contexts or photoreal illegal content.
  • Adheres to all other applicable federal, state, and international laws governing digital content and online services.
  • Cooperates promptly with lawful requests from governmental authorities.
